Terms of Service

1. Acceptance of terms

These Terms constitute a binding agreement between you (the "Merchant") and Koombiyo Delivery ("we", "us") governing your use of the Koombiyo Delivery Shopify application.

2. Description of service

Koombiyo Delivery is a Shopify-embedded application that integrates your store with Koombiyo's delivery network. The service provides:

• Automatic sync of Shopify orders into a delivery queue
• Shipment creation via the Koombiyo API with waybill assignment
• Real-time delivery status tracking
• Pickup request scheduling
• Proof of Delivery document generation

The app is an integration layer only. Actual delivery services are provided solely by Koombiyo — we are not a delivery provider.

3. Eligibility & account requirements

• An active Shopify store, compliant with Shopify's Terms of Service
• A valid, active Koombiyo Delivery merchant account and API key
• At least 18 years old or the age of legal majority in your jurisdiction

You're responsible for the security of your Shopify account and Koombiyo API key. Notify us at SALES@KOOMBIYODELIVERY.COM if you suspect unauthorized access.

4. Merchant obligations

• Provide accurate pickup address, phone, and GPS coordinates
• Ensure customer delivery addresses and phone numbers are accurate
• Use the app only for legitimate commercial delivery operations
• Not attempt to reverse-engineer or exploit the app
• Comply with Shopify's Partner Program Agreement and App Store policies

5. Koombiyo API & third-party services

The app transmits order data to Koombiyo's API to create shipments. Actual delivery services are governed separately by Koombiyo's Terms and Conditions of Delivery of Goods, which you accept by using Koombiyo's delivery service through this app. We are not responsible for Koombiyo API availability, delivery failures, or delays caused by Koombiyo's operations.

6. Data & privacy

Your use of the app is also governed by our Privacy Policy, incorporated here by reference. We process order and customer data solely to provide the delivery service and comply with Shopify's mandatory GDPR webhooks.

7. Prohibited uses

• Shipping prohibited or illegal goods
• Creating fraudulent or fictitious shipments
• Scraping or extracting data beyond normal use
• Introducing malware or harmful code

8. Intellectual property

The app, its code, and design are the intellectual property of Koombiyo Delivery. You are granted a limited, non-exclusive license to use it for its intended purpose. You retain full ownership of your store, order, and customer data.

9. Disclaimers & limitation of liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. KOOMBIYO DELIVERY IS NOT LIABLE FOR INDIRECT DAMAGES, DELIVERY FAILURES CAUSED BY KOOMBIYO'S SERVICES, OR SHOPIFY PLATFORM OUTAGES BEYOND OUR CONTROL.

10. Indemnification

You agree to indemnify Koombiyo Delivery against claims arising from your use of the app or violation of these Terms.

11. Termination

You may uninstall the app at any time — we delete your session data immediately. We may suspend access if you violate these Terms or Shopify's policies.

12. Changes to these terms

We may modify these Terms; material changes will be notified at least 14 days in advance via the Shopify admin or account email.

13. Governing law

These Terms are governed by the laws of Sri Lanka. Disputes are subject to the exclusive jurisdiction of the courts of Sri Lanka.
